Policies & Terms Of Service
These terms and conditions constitute a binding agreement between the client and Gem & Jewel Photography for professional photography services. By booking services, the Client agrees to the following terms:
1. Purpose and Use of Funds
Revenue collected by Gem & Jewel Photography is used for maintaining photography equipment, purchasing business-related supplies (e.g., business cards, hard drives, flash drives), website upkeep, and photo editing software.
2. Booking, Deposits, and Payment Policy
2.1 Deposit Requirement
A non-refundable deposit is required to secure your appointment. The deposit amount and due date will be specified at the time of booking and is necessary to reserve the Photographer’s time and resources.
2.2 Final Payment
The remaining balance of the total service fee must be paid in full no later than seven (7) calendar days prior to the scheduled appointment. Failure to pay the full amount by the due date may result in cancellation of the session, and the time slot may be made available to other clients.
2.3 Payment Method
Accepted payment methods include Cash, Venmo, Paypal, and Cash App.
3. Cancellations and Refund Policy
3.1 Cancellations by Client
All deposits are non-refundable under any circumstances, including but not limited to cancellations, rescheduling, or no-shows by the Client.
3.2 Cancellations by Photographer
In the rare event the Photographer must cancel, the Client will be entitled to a full refund of all amounts paid or may reschedule at no additional cost.
4. Photo Delivery and Editing Policy
4.1 Client Satisfaction
While every effort is made to ensure Client satisfaction, photography is a creative service, and artistic interpretation may vary. Edits and final images are delivered between 1-3 weeks.
4.2 Dissatisfaction and Remedies
If the Client is not satisfied with the final product, the Photographer may, at their sole discretion, offer alternative resolutions (e.g., re-editing or reshoot). These remedies are not guaranteed and are considered goodwill gestures.
If such an agreement is reached, the Client agrees to return or delete all digital and physical copies of the original photos in question. The Client may not reproduce, share, publish, or sell any image involved in a dissatisfaction agreement.
4.3 Unauthorized Use
If it is discovered that any returned, disputed, or restricted image(s) have been copied, distributed, altered, or used without express written permission from the Photographer, legal action may be pursued for breach of agreement and copyright infringement under applicable U.S. and North Carolina law.
5. Copyright and Usage Rights
All early release ("sneak-peak") photographs taken by Gem & Jewel Photography are the exclusive property of the Photographer and are protected under U.S. Copyright Law (Title 17, U.S. Code). Clients will receive a photo release with the delivery of the final images.
6. Governing Law
This Agreement shall be governed and interpreted in accordance with the laws of the State of North Carolina, without regard to its conflict-of-law provisions. Any legal disputes arising from this Agreement shall be brought in the appropriate courts located in Cleveland County, North Carolina.
7. Acknowledgment and Acceptance
By booking with Gem & Jewel Photography, the Client acknowledges that they have read, understood, and agreed to these terms of service.
